La abogada que representa como acusación particular a los padres de Julen, el niño de dos años que cayó a un pozo de gran profundidad y cuyo cuerpo fue rescatado 13 días después, ha solicitado tres años y medio de prisión para el dueño de la finca de Totalán donde murió el pequeño. Así lo han confirmado fuentes judiciales, quienes han apuntado que esta acusación achaca al procesado un delito de homicidio por imprudencia grave, al igual que hizo la Fiscalía malagueña, que en sus conclusiones iniciales solicitó una pena de tres años de prisión para el único acusado en este caso, David Serrano, cuya defensa ha pedido el sobreseimiento. La acusación que representa a los padres insta a que se imponga una pena mayor de la pedida por el fiscal y considera en su escrito que hay una negligencia en el dueño de la finca que es extremadamente grave.
