Juana Rivas ha interpuesto ante la Audiencia Provincial un recurso de apelación para que revoque el auto del Juzgado de Instrucción 3 de Granada que denegó la adopción de medidas cautelares para proteger a sus hijos, que han de volver con su padre a Italia el próximo 14 de agosto tras el periodo vacacional estipulado. El juzgado en que recayó la denuncia de esta madre de Maracena frente a su expareja por presunto delito de maltrato hacia los hijos, resolvió el pasado viernes no adoptar ninguna medida de protección sobre los menores y remitió el caso a la Justicia italiana. En el recurso de apelación ante la Audiencia no se discute que la competencia de los hechos corresponde a la jurisdicción italiana, si bien solicita que se escuche a los menores, sobre todo al hijo mayor, que tiene ya 13 años.

Juana Rivas has filed an appeal with the Provincial Court to revoke the order of the Court of Instruction Court 3 of Granada that denied the adoption of precautionary measures to protect her children, who must return to Italy on 14 July August after the stipulated holiday period. The court in which the complaint of this mother of Maracena fell against her ex-partner for alleged crime of child abuse, resolved last Friday not to adopt any protection measure for minors and referred the case to the Italian Justice. In the appeal before the Court it is not disputed that the competence of the facts corresponds to the Italian jurisdiction, although it requests that the minors be heard, especially the eldest son, who is already 13 years old.
